Terms of Use
Effective date: May 1, 2026
Last updated: May 19, 2026
1. Acceptance of Terms
By downloading, installing, or using the MyAI Health extension ("the Extension"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Extension.
2. Not Medical Advice
The Extension is an information retrieval tool only. It fetches your health records from Alberta's My Health Records and AHS MyChart portals and presents them through an AI assistant (Claude, by Anthropic).
The Extension does not provide medical advice, diagnosis, or treatment recommendations. Any information provided by the AI assistant — including summaries, explanations, or interpretations of your health data — is generated by artificial intelligence and is not a substitute for professional medical judgment.
The Extension is not a medical device, health care service, or clinical decision support system. It has not been reviewed or approved by Health Canada or any regulatory body.
3. Not for Emergencies
This Extension is not designed for medical emergencies. If you are experiencing a medical emergency, call 911 or go to your nearest emergency department immediately. Do not rely on this Extension for urgent health concerns.
4. No Professional Relationship
Use of the Extension does not create a doctor-patient, healthcare provider, or any other professional relationship between you and the creator(s) of the Extension. You should always consult with a qualified healthcare professional for medical decisions.
5. Data Accuracy and Completeness
Health data displayed through the Extension is retrieved directly from Alberta Health Services' portals (My Health Records and AHS MyChart). The Extension acts as a passthrough — it does not create, modify, or validate health data.
We make no guarantees regarding the accuracy, completeness, timeliness, or reliability of the data retrieved. Data may be delayed, incomplete, or contain errors originating from the source systems. Always verify important health information with your healthcare provider or the official portals directly.
6. AI-Generated Content
When your health data is presented through the Extension, it is processed by Claude, an AI assistant developed by Anthropic. The AI may summarize, organize, or contextualize your data.
AI-generated responses may be inaccurate, incomplete, or misleading. The AI does not have access to your full medical history, clinical context, or other factors that a healthcare provider would consider. Do not make health decisions based solely on AI-generated interpretations of your data.
7. Third-Party Services
The Extension and Portal rely on third-party services that are outside of our control:
- Alberta Health Services — My Health Records and AHS MyChart portals (data source)
- Anthropic — Claude AI assistant (used in the Claude Desktop / .mcpb path; US-based servers)
- Microsoft Azure — Cloud infrastructure (Canada Central and Canada East); Azure OpenAI Service (Canada East) is used as the AI provider in the Portal beta path
- Alberta's MyAlberta Digital ID — Authentication
We are not responsible for the availability, accuracy, security, or performance of these third-party services. Their use is subject to their own terms and privacy policies.
8. Data and Privacy
Two delivery paths — different data flows
MyAI Health is offered through two distinct paths, each with a different data flow. Please read the section that applies to how you use the product.
8a. Claude Desktop Extension (.mcpb path)
When you install the Extension via the downloadable .mcpb file and use it within Claude Desktop:
- The Extension runs locally on your computer.
- Your health data is fetched directly from Alberta's health portals to your machine. It does not pass through our servers.
- Your health data is then sent to Anthropic's Claude AI (servers located in the United States) for the AI conversation. See Anthropic's privacy policy and their Consumer Health Data Privacy Policy.
- Encrypted session cookies are stored locally on your machine only (AES-256-GCM). No health data is stored on your machine or our servers.
- Your login credentials are entered on Alberta's own sign-in page and are never transmitted to or stored by us.
8b. Portal Beta (web chat path)
When you use the MyAI Health web portal (beta) at myaihealth.ca:
- Your health data is fetched from Alberta's health portals via our server, which runs on Microsoft Azure Canada Central. Data passes through our infrastructure during the active session.
- Your health data and conversation messages are sent to Azure OpenAI Service (Microsoft-hosted, Canada East region) for AI processing. All AI inference occurs within Canada.
- Health data is held in memory only for the duration of your active session. It is not persisted to any database, log file, or long-term storage on our side.
- Conversation transcripts are stored locally in your browser (localStorage). They are not stored on our servers. Clearing your browser data will remove them.
- Encrypted session tokens (AES-256-GCM) are stored in your browser for the duration of the active session (~10 minutes before expiry). They contain authentication state only — no health data.
- Your login credentials are entered on Alberta's own sign-in page and are never transmitted to or stored by us.
- Azure OpenAI abuse monitoring: Microsoft Azure OpenAI may retain prompt and completion data for up to 30 days for abuse detection purposes, unless an opt-out has been approved. We do not use your data for AI model training. See Azure OpenAI data, privacy, and security.
8c. Canadian Data Residency (Portal Beta)
All infrastructure operated by MyAI Health for the Portal beta path is located in Canada:
- MCP server / API: Microsoft Azure Canada Central
- AI inference: Microsoft Azure OpenAI Service, Canada East
- Website hosting: Microsoft Azure Static Web Apps (Canada Central)
This infrastructure is operated under contracts with Microsoft Azure in compliance with Alberta's Health Information Act (HIA) and Protection of Privacy Act (POPA).
Claude Desktop / .mcpb path exception: Conversations through Claude Desktop are processed by Anthropic on US-based servers. We do not control Anthropic's infrastructure or data handling. See Anthropic's policies for details.
9. Your Rights Under Alberta Privacy Law
Your health information is protected by Alberta's Health Information Act (HIA) and Protection of Privacy Act (POPA). As a user, you have the right to:
- Access: Request a copy of any personal information we hold about you (note: we hold no health data — only session authentication state).
- Correction: Request correction of any inaccurate personal information we hold.
- Complaint: File a complaint about our privacy practices with the Office of the Information and Privacy Commissioner of Alberta (OIPC) at www.oipc.ab.ca.
For privacy requests or concerns, contact us at support@myaihealth.ca.
10. User Responsibility
You are solely responsible for:
- Verifying any health information with your healthcare provider before acting on it
- Safeguarding your MyAlberta Digital ID credentials
- Understanding that AI-generated content may contain errors
- Ensuring your use of the Extension complies with applicable laws
- Seeking professional medical advice for any health concerns
11. Disclaimer of Warranties
THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that the Extension will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the Extension will be accurate or reliable.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE CREATOR(S) OF THE EXTENSION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use the Extension
- Any health decisions made based on information obtained through the Extension
- Any inaccuracies or errors in data retrieved from health portals
- Any AI-generated content, interpretations, or summaries
- Unauthorized access to your data or sessions
- Any interruption or cessation of the Extension's functionality
- Any third-party service failures or data breaches
This limitation applies regardless of the legal theory under which liability is asserted, including negligence, contract, strict liability, or any other basis, even if we have been advised of the possibility of such damages.
13. Indemnification
You agree to indemnify, defend, and hold harmless the creator(s) of the Extension from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Extension, your violation of these Terms, or your violation of any rights of a third party.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Extension after changes constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Extension shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta.
16. Contact
If you have questions about these Terms, please contact us at support@myaihealth.ca.
